EdOrbis (The Product) is owned wholly by Global Study Tech Limited (The Company).
These Terms of Services (“Terms”) govern your access to and use of the services provided by the Company (www.edorbis.com). It includes our various websites, SMS, API’s, email notifications, applications, products, buttons, widgets, advertisements, commercial processes and other admission & application processes (“Services”). It also includes the any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms. Your agreement is with Global Study Tech Limited.
The Product is an independent platform which aims to assist students and professionals from across the world to build their academic and professional careers through a single environment. We wish to connect the world through education. Our products and services are designed to promote economic, social and cultural productivity allowing you to join millions of other like-minded individuals across the world to meet, exchange ideas, learn and explore education and career opportunities in safe and trusted environment. The Product guides you through each critical junction of your career by providing access to the Product. The Company accumulates key stakeholders to support you by providing critical support, products and services to ensure you are making a sound decision.
You retain your rights to any Content you submit in the Product and any approved product, post or display on or through the Services. By submitting, posting or displaying Content on or through the Services, you grant the Company a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). You agree that this license includes the right for the Company to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organisations or individuals who partner with the Company for the syndication, broadcast, distribution or publication of such Content on other media and services, subject to our terms and conditions for such Content use.
All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of the Company and its subsidiaries. Nothing in the Terms gives you a right to use the Product name, domain names, logos, and other distinctive company features. Any feedback, comments, or suggestions you may provide regarding the Product or its subsidiaries, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
Content Management & Usage
You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content and information you submit, post, or display will be able to be viewed by other users of the Services and through third party services and websites that have partnered with the Company. You should only provide Content that you are comfortable sharing with others under these Terms.
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabelled or are otherwise deceptive.
Under no circumstances will the Company be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.
The Company reserves the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Services, to suspend or terminate users, and to reclaim usernames without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of the Company and the Product, its users and the public.
You may not do any of the following while accessing or using the Services provided by the Company:
- probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;
- access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by the Product.
- forge or attempt to forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information;
- to forge the use of the Product or any other associated logo to create or distribute deceptive or false source-identifying information;
- to access, tamper with, or use non-public areas of the Services provided by the Company;
- interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
Services & Limitation
The Services that the Company provides are constantly evolving and the form and nature of the Services are subject to change. Changes to our Services may be undertaken without prior notice to you. In addition, the Company reserves the right to stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you. The Services may include advertisements from education institutions and a range of other institutions, corporations, government bodies which the Company may consider to be of interest to you and other users. The types and extent of advertising and information presentation by the Company on the Services are subject to change. In consideration for the Company granting you access to and use of the Services, you agree that the Company and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
Student Service Agreement
EdOrbis (The Product) is owned wholly by Global Study Tech Limited (The Company).
The Applicant wishes to apply to pursue studies abroad and is fully sponsored by your government or officially recognised scholarship awarding body (the “Sponsor”). The Applicant has agreed for the Company to represent them and will seek assistance from specialist resources at each stage of the application, admission and immigration phase. The Company will assist the Applicant to better understand options of pursuing studies to a range of Nominated Education Institutions and Host Countries.
Obligation of the Company
- To provide independent advice, discuss and assist the Applicant to better understand options related to courses, programmes, institutions and countries to select from.
- Help prepare the application, which may consist of reviewing and refining personal statements, references and certificates which need to be authenticated.
- Assist in completing and submitting Application(s) to Nominated Education Institution(s).
- Work with Applicant to understand offers and any associated conditions which need to be fulfilled.
- Where necessary, organise immigration related services related to preparing and submitting visa application forms to target country of study.This may incur additional charges which shall be paid for by the Applicant or Nominated Education Institution.
- To assist in pre-departure briefing prior to the Applicant departing to the Host Country.
Obligations of the Applicant
- Not to work with multiple representatives. To immediately declare in writing to the Company any unsolicited attempt from unauthorised Parties who attempt to advise the Applicant.
- To provide accurate and timely information.
- To be open and honest in all declarations.
- Immediately communicate the status of each application in the Product.
- To meet deadlines in order to avoid unnecessary delays in the application, admission or immigration processes.
Withdrawal of Application
If at any time, the Applicant withdraws his/her application, he/she will notify via the Product and the Nominated Education Institution immediately and provide evidence satisfactory to the Company. If the Applicant chooses to pursue an Application through alternative routes the Company is entitled to seek reasonable payments for services provided to date from the Applicant or any other 3rd party choosing to represent the Applicant.
Applicant acknowledges that the Company shall be entitled to Commission payments from Nominated Education Institutions upon the Applicant’s successful enrollment.
Cost of Services
Where explicitly stated, the services provided to the Applicant will be free of charge. Applicant understands that when the Company introduces the Applicant to other services and/or companies which provide related services, it may be paid a commission by, or receive other benefits from, such companies or charge the Student for such products and/or services. The cost of such services will be communicated clearly and if the Applicant is required to pay for such services, the Product will provide a receipt. Applicant shall never be asked to make payments without a documented receipt.
Disclosure of Personal Information
The Company shall be entitled without further direction of the Applicant to disclose personal information to authorised 3rd parties in order to avoid or mitigate risks and fraud.
Termination, Complaints, Resolution and Limitation of Liability & Indemnity
Applicants wishing to terminate this Agreement or raise a complaint can send an email to the Company on firstname.lastname@example.org. Both Parties agree to friendly discussions and arbitration to resolve matters in a prompt and efficient manner. The Company shall not be responsible in any way for any delay in effecting a transfer which is caused by the Applicant or any other third party, including but not limited to bank delay, postal delay, failure or delay of any fax or electronic transmission or delay caused by accident, emergency or act of God. For the avoidance of doubt the Applicant accepts that the Applicant is solely responsible for ensuring that all paperwork, payments which he/she is required to make are made promptly and within the time limits. This Agreement shall automatically terminate once the Company receives all outstanding payments.
General & Applicable Law
These Terms and Conditions and the Application process set out the entire agreement and understanding of the parties on the subject matter of this agreement and supersede all previous oral and written communications on the same subject matter. In the event of any inconsistency, discrepancy or ambiguity between these Terms and Conditions and the Application Form, these Terms and Conditions shall prevail. These Terms and Conditions shall be governed by the law and subject to the exclusive jurisdiction of the courts of the country where you reside.
